tourView — Beta End User License Agreement
This End User License Agreement ("Agreement") is a binding contract between you ("you") and the operator of tourView ("we", "us"). By ticking "I agree", creating an account, or using tourView (the "Service"), you accept this Agreement. If you do not agree, do not use the Service.
1. Beta status; no warranty
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied or statutory, including (to the maximum extent permitted by law) merchantability, fitness for a particular purpose, accuracy, availability and non-infringement. Beta features may be unstable, may be changed or removed without notice, and may cause loss of data. There is no service-level commitment, uptime guarantee, or support obligation during the beta.
2. Licence
Subject to this Agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for the purpose of evaluating it during the beta. We reserve all rights not expressly granted.
3. Restrictions
- Do not copy, sell, rent, sublicense, or commercially exploit the Service.
- Do not reverse engineer, decompile, or attempt to extract source code, except where this restriction is prohibited by law.
- Do not probe, attack, overload, or attempt to gain unauthorised access to the Service or other users' data.
- Do not use the Service unlawfully or to store unlawful content.
- Access is invite-only; do not share your account or invite codes.
4. Confidentiality of the beta
The Service, its non-public features, and your access to the beta are confidential. You agree not to publicly disclose, benchmark, or share screenshots of non-public functionality without our prior written consent.
5. Your content and data
You retain ownership of the tour data and content you submit ("Your Content"). You grant us a licence to host, process and display Your Content solely to operate and improve the Service. You are responsible for Your Content and confirm that you have the rights and, where required, the consent of any individuals (e.g. crew, contacts) whose personal data you enter. Our handling of personal data is described in our Privacy Policy.
6. Feedback
If you give us feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without restriction or obligation to you.
7. Limitation of liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goodwill, or data, arising out of or related to the Service or this Agreement, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the claim (which, during the free beta, is £0) or (b) £50.
Nothing in this Agreement excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or your non-excludable statutory consumer rights.
8. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from Your Content or your breach of this Agreement or of applicable law.
9. Suspension and termination
Because this is a beta, we may suspend, limit, or terminate your access, or discontinue the Service, at any time and for any reason, with or without notice. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (e.g. 5–8, 11) survive.
10. Changes to the Service and this Agreement
We may update the Service and this Agreement. If we make material changes to this Agreement, we will require you to accept the updated version before continuing to use the Service. Continued use after non-material changes constitutes acceptance.
11. Governing law
This Agreement is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without prejudice to any mandatory consumer-protection rights you have in your country of residence.
